DMCA Policy

Easy Apple Stuffing ("we," "us," or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, we have adopted a policy of responding to notices of alleged infringement that are properly provided to us.

This policy describes the information that should be present in a DMCA notification and counter-notification, and outlines how we will address such notices.

Filing a DMCA Notice of Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on the Easy Apple Stuffing website, please provide our designated Copyright Agent with a written notice containing the following information:

  1. Identification of the Copyrighted Work: A description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., URL(s) of the specific page(s) where the material is found on easyapplestuffing.com).
  3. Contact Information of the Complaining Party: Your full legal name, mailing address, telephone number, and email address.
  4. A Statement of Good Faith Belief: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A Statement of Accuracy and Consent to Jurisdiction: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. Also, a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Easy Apple Stuffing may be found, and that you will accept service of process from the person who provided the original notification of infringement or an agent of such person.
  6. Electronic or Physical Signature: An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.

Filing a DMCA Counter-Notification

If you believe that material you posted on Easy Apple Stuffing was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us. Your counter-notification must contain the following information:

  • Identification of Removed Material: Identification of the material that has been removed or to which access has been disabled and the location (e.g., URL(s)) at which the material appeared before it was removed or disabled.
  • A Statement Under Penalty of Perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your Contact Information: Your name, address, and telephone number.
  • A Statement Consenting to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Easy Apple Stuffing may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Your Electronic or Physical Signature: Your electronic or physical signature.

Please send your DMCA counter-notification to our designated Copyright Agent via the contact methods provided on our Contact Us page, clearly marking the subject line as "DMCA Counter-Notification".

Upon receipt of a valid counter-notification, we will forward it to the party who submitted the original DMCA notification. If the complaining party does not file a court action seeking a court order to restrain the subscriber from engaging in infringing activity on our site within 10-14 business days of receiving the counter-notification, the removed material may be restored or access re-enabled, at our sole discretion.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability.
